Terms of Service — Prime Tempr

1. About Prime Tempr

Prime Tempr is a global marketplace and business platform for independent yoga, meditation, fitness, Ayurveda, and wellness professionals. Businesses can publish storefronts, free previews, paid programs, memberships, live sessions, and other services. Prime Tempr may also offer optional platform-level wellness tools in limited beta.

Prime Tempr is currently operated by Praveer Sharma (sole proprietor) pending business incorporation. When Prime Tempr incorporates, these Terms are assignable to the successor entity without further notice.

2. Acceptance

By creating an account or using Prime Tempr, you agree to these Terms. If you do not agree, do not use the service.

3. Accounts

You must be at least 18 years old to create an account. You are responsible for safeguarding your account credentials and for all activity under your account.

4. Subscriptions

Prime Tempr operates as a marketplace for independent wellness professionals and businesses ("trainers"). When you subscribe, you purchase access from a trainer through the Prime Tempr platform. Each trainer sets their own price, billing period, and included access. The exact classes, programs, live sessions, and community features included in a plan are shown before checkout.

Prime Tempr does not sell a competing first-party content membership. Trainer memberships are trainer-owned. Optional platform tools and Prime Tempr Studio are separate Prime Tempr services and are clearly identified as such.

Subscriptions auto-renew at the price displayed at signup unless you cancel before the renewal date. You may hold subscriptions to multiple trainers simultaneously; each is an independent transaction with its own billing cycle.

5. Free tier and trial

Anyone can use Prime Tempr's free tier without payment to browse public storefronts, view free lessons and previews shared by trainers, discover sessions and programs, and manage their practice history and schedule. Free content remains owned and selected by the trainer who published it.

Where a seven (7) day trial of a premium Prime Tempr tool is offered, it begins only after the user deliberately starts that tool. Creating an account or browsing free content does not start the trial. Trial availability, scope, and end date are shown before activation. When a trial ends, access returns to the free tier unless an eligible paid plan is active.

6. Refunds

See our separate Refund Policy. In summary, eligible requests may be made within seven days of a charge, subject to consumption and applicable consumer law. Any statutory rights that apply in your country remain unaffected.

7. Trainer content

Trainers retain ownership of the content they upload. By uploading, trainers grant Prime Tempr a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content through the platform. Detailed terms for trainers are in the separate Trainer Agreement.

8. User conduct

Users may not:

• Upload unlawful, harmful, or infringing content
• Harass other users or trainers
• Attempt to reverse-engineer AI features or scrape content at scale
• Use Prime Tempr for any purpose other than personal wellness practice

Prime Tempr may suspend or terminate accounts that violate these rules.

9. Wellness, not medical advice

Prime Tempr provides wellness and educational content, not medical advice. Prime Tempr Guide, pose guidance, and any food or practice suggestions are informational only and are not a substitute for professional medical, psychiatric, physiotherapy, or nutritional advice. These tools must not be used for diagnosis, injury assessment, pregnancy-specific decisions, medication decisions, or emergencies. Consult a qualified professional before changing an exercise or dietary regimen if you have a medical condition or concern.

What Prime Tempr Guide may use

When Prime Tempr Guide is enabled and you choose to use it, the model may use the following account context to make a response more relevant:

• Your first name
• Your dosha if you've taken the questionnaire (Vata / Pitta / Kapha mix)
• The goals you set during onboarding (flexibility, stress relief, sleep, etc.)
• Your stated experience level (beginner / intermediate / advanced)
• Your time zone, locale, and the current local time (so the advice fits the time of day and season)
• Your subscription state
• A short summary of your recent practice on Prime Tempr — which classes you've watched, when, and what they focus on
• Up to the last ten turns of the current conversation, plus a small set of facts the coach has previously extracted from your messages (called "context facts" — visible and deletable from your profile)

We do not share this information with anyone outside the model that generates the response. We do not train any model on your conversations. Conversations are stored under your account so you can return to them; you can delete a conversation at any time from the coach UI, and we will purge the underlying records on a 30-day rolling window after your account is deleted.

Prime Tempr Guide is read-only. It cannot make changes to your account or subscription, and it does not speak on behalf of a trainer.

10. Intellectual property

Prime Tempr's name, logo, platform code, AI models, and original content are owned by Prime Tempr (or licensed to it). You receive a limited, non-transferable license to use the service for personal, non-commercial wellness purposes.

11. Limitation of liability

To the maximum extent permitted by applicable law, Prime Tempr's aggregate liability to any user for claims arising out of or relating to the service is limited to the greater of (a) fees paid by you to Prime Tempr in the twelve months before the claim or (b) one hundred US dollars (USD $100).

Prime Tempr is not liable for indirect, incidental, consequential, special, or punitive damages.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which Prime Tempr is incorporated at the time of dispute, or by the laws of India during the pre-incorporation period, without regard to conflict-of-law principles. Disputes will be resolved in courts of competent jurisdiction in that forum.

13. Changes to these Terms

Prime Tempr may update these Terms from time to time. Material changes will be announced via email or in-product notice at least 14 days before taking effect.
